Deed Restriction Revisions

BEFORE you click to open and read this document, UNDERSTAND that this is a work-in-progress.  In response to feedback from you, the homeowners of Emerald Gardens, the Board of Directors is currently working to rewrite the Emerald Gardens Bylaws and Deed Restrictions.  The process for this project is this:

 

1.      Discuss process with Emerald Gardens’ attorney.

2.      Review each Deed Restriction.

3.      At the next Board meeting, arrive prepared to discuss possible revisions.

4.      During the Board meeting, consider past situations, complaints, comments, surveys, etc of homeowners.

5.      During the Board meeting, finalize the revision for specific restriction(s).

6.      Throughout the process, review all comments and surveys received from homeowners.

7.      Once the document is complete, notify via email (if you haven't submitted your email address to the Board, please consider doing that) the homeowners of the proposed document.  Look for comments.

8.      At the July semi-annual meeting, open the floor for discussion.

9.      Make any necessary changes.

10.   Present to attorney for review and/or revisions.

11.   At the January annual meeting, conduct a vote for revised Bylaws and Deed Restrictions.

12.   If/when approved, file with Sarasota County and distribute final copy to homeowners.

 

Remember, we have 30 deed restrictions in addition to the Bylaws.  At each Board meeting, we take one item at a time.  One meeting we may get through 9 items, while the next meeting we may only get through 1 or 2.  The time involved depends on the topic and its sensitivity.  When we get to a block, we consult the attorney along the way.  We are volunteering our time to serve on the Board of Directors and we are using our time in ways that YOU have asked.  While we have a fairly diverse representation of homeowners that serve on the Board, we can’t possibly share every homeowner’s opinions on every topic.  Therefore, your constructive opinions and suggestions are very much appreciated.

 

Finally, to keep updated on the process, you’ll want to check this website at least once a month.  If you haven’t shared your email address with the Board, please consider doing this.  We will send out an email to advise you when an update has been posted.  To save on printing and postage expenses, we will not be mailing out information until we get to a point where we are obligated to do so. 

 

One final thought, no changes will be made without a majority vote of ALL homeowners.
